XUKIUMThese Terms and Conditions (“Terms”) govern the use of the Xukium desktop application for Windows (“the Application”) and the xukium.com website (“the Site”), together “the Service”. By creating an account, downloading or using the Service you accept these Terms. If you do not agree, do not use the Service.
1. Who provides the Service
The Service is provided by Xukium (“we”), established in Honduras. You can contact us through the support page or at support@xukium.com.
Xukium is an independent project. It is not affiliated with, endorsed by or sponsored by Mojang Studios or Microsoft (see Intellectual property and trademarks).
2. What Xukium is
Xukium is a software tool to create, configure, run and manage Minecraft servers that run on your own computer. It is not a hosting service: we do not host or operate your servers.
The current version of the Application is a beta (0.1.0-beta). It may contain errors, change without prior notice and is not intended for environments where a failure could cause serious harm.
3. Accounts and eligibility
- You need an account to use certain features of the Application and the Site. To register you must provide truthful information and keep it up to date.
- You must be at least 13 years old. If you are below the age at which the law of your country lets you accept this kind of agreement on your own, you need the permission of your parent or legal guardian.
- You are responsible for keeping your credentials confidential and for activity carried out with your account. Let us know without delay if you detect unauthorized use.
- We may ask you to verify your email address to activate the account.
4. Software license
We grant you a personal, limited, non-exclusive, revocable and non-transferable license to install and use the Application on your Windows devices, in accordance with these Terms and your plan.
Unless applicable law expressly allows it, you may not: copy, modify or distribute the Application; resell or sublicense it; decompile it or attempt to extract its source code; or remove proprietary notices.
5. Free and Plus plans
- Xukium Free: free use within the plan limits, including management of 1 server.
- Xukium Plus: a paid subscription (USD 4.99 per month or USD 52.99 per year) that expands capacity and tools, including up to 6 servers, scheduled backups and restore, world management, Modrinth integration, playit.gg tunnels and advanced metrics.
Features, limits and prices may evolve. Plans are not “unlimited”: actual limits of use, compatibility and capacity depend on the Application and on your computer. Purchase, renewal, cancellation and refund conditions are in the subscriptions and refunds policy. Payments are processed by Paddle.
Access to Plus features is granted according to your subscription status as validated by our systems; it does not depend solely on data that can be edited on your computer.
6. Local servers and your responsibility
- Your servers run on your computer. Their performance, capacity, availability and connectivity depend on factors outside our control: your hardware resources, your Internet connection, the operating system, network and router configuration, ports, external connectivity services, the Minecraft version and the mods, plugins and other components you install.
- We do not promise permanent availability of your servers or uninterrupted operation of your connection.
- You are responsible for having the necessary permissions to use your computer, your networks and the files you manage.
- Opening ports or exposing a server to the Internet carries security risks. Configuring and protecting it is your responsibility; we recommend using whitelists and keeping everything up to date.
- You are responsible for your backups. Although the Application offers tools to create them, we do not guarantee they will prevent all data loss.
- To run a Minecraft server you must comply with Mojang/Microsoft's End User License Agreement (EULA) and commercial usage rules.
7. Third-party services and content
Xukium relies on or integrates with external services such as Firebase (Google), Cloudflare, Paddle, GitHub, Modrinth and playit.gg. Each has its own terms and policies, which you must follow when using them. We do not control those services and are not responsible for their availability or content.
You are responsible for ensuring that the mods, plugins, worlds and other files you add are compatible with your setup and that you can legally use them.
8. Acceptable use, security and licenses
You agree to follow our Acceptable use policy. In particular, you must not tamper with payments, the license system or security mechanisms, bypass your plan's limits, or access accounts or systems without authorization.
We may use license checks to determine which features are enabled and take reasonable measures against fraud, license tampering and uses that compromise the security of the Service.
9. Intellectual property
The Application, the Site, the Xukium brand, the design and original materials are the property of Xukium or its licensors. These Terms do not transfer any ownership rights to you. The content and files you create or add (worlds, configurations, etc.) remain yours or their owners'. More information in Intellectual property and trademarks.
10. Availability and changes
The Service may experience interruptions due to maintenance, technical failures, connectivity problems or incidents at external providers. We may update, improve, modify or withdraw features. When a change materially affects a paid feature you have purchased, we will notify you with reasonable advance notice and, where the law requires, you will have the options that apply.
11. Suspension and termination
You may stop using the Service and request deletion of your account at any time (see the privacy policy). Cancelling a subscription is a separate step, described in the subscriptions and refunds policy.
We may suspend or close an account where there is a valid cause, for example serious or repeated breach of these Terms, fraud, risk to the security of the Service or a legal obligation. Where reasonable, we will notify you and give you the chance to fix the situation.
12. Warranties and limitation of liability
The Service, especially the beta version and the free plan, is provided “as is” and “as available”. To the maximum extent permitted by law we do not guarantee that it will be error-free or that it will work without interruption.
To the maximum extent permitted by law, we will not be liable for indirect damages, loss of profit, loss of data, worlds or backups, or for failures arising from your computer, your network, third-party services or content you install.
Nothing in these Terms excludes or limits the rights that applicable law mandatorily grants to consumers, or liability that cannot be excluded by law (for example, for wilful misconduct or gross negligence, or for personal injury).
13. Changes to these Terms
We may update these Terms. We will publish the current version on this page with its date. If the change is material, we will notify you through the Site, the Application or by email before it takes effect. If you keep using the Service after that date, you accept the new version; if you disagree, you can stop using it and cancel your subscription.
14. Governing law and dispute resolution
These Terms are governed by the laws of Honduras, without prejudice to the mandatory rights you have as a consumer in your country of residence. We will try to resolve any dispute amicably through support before turning to other avenues.
